These General Terms and Conditions of Sale (“Terms”) govern the relationship between Lamrani & Salces S.L. (“we,” “our,” or “the Company”) and any person or entity (“you” or “the Customer”) who purchases products from our retail business, online via www.kikanart.com. By making a purchase, you agree to be bound by these Terms.

3. Product Information and Availability
• Product Description: We strive to ensure product descriptions, images, and pricing are accurate. However, we do not guarantee that all information will be completely error-free or up to date.
• Availability: All orders are subject to product availability. In the event a product is unavailable after an order is placed, we will notify you promptly to offer alternatives or a cancellation.
4. Pricing and Payment
• Pricing: Prices are in Euro and include applicable taxes unless specified otherwise. We reserve the right to adjust prices without prior notice, though these changes will not affect orders already confirmed.
• Payment Methods: Accepted payment methods are listed on our website. Payment must be completed in full at the time of purchase.
• Payment Security: We use secure measures to protect your payment information but cannot be held liable for unauthorized access to payment data beyond our control.

5. Order Confirmation and Acceptance
All orders are subject to acceptance by the Company. Upon receiving your order, we will send a confirmation email or receipt. This confirmation does not signify final acceptance of the order; we reserve the right to cancel an order if necessary (e.g., in cases of pricing errors or stock issues).
6. Shipping, Delivery.
• Delivery Location: Products will be delivered to the address specified by the Customer at the time of order or made available for collection from authorized collection points.
• Delivery Times: Delivery times are estimates and may vary. The Company is not responsible for delays caused by external factors outside our control.
• Shipping Costs: Shipping fees are calculated at checkout and added to the total order cost. Certain promotions may provide free or discounted shipping.
7. Risk and Ownership Transfer
• Risk of Loss: Risk of loss or damage to products transfers to the Customer upon delivery.
• Ownership: Ownership of products passes to the Customer once the Company has received full payment for the order, including applicable shipping fees.
8. Returns, Exchanges, and Refunds
• Return Policy: Customers may return products within 15 days of receipt, provided they are in original condition and unused. Certain items, including sale or final clearance items, may not be eligible for return.
• Return Process: To initiate a return, the Customer should contact our customer service team. Unless the return is due to a defective or incorrect item, the Customer is responsible for return shipping costs.
• Refunds: Refunds will be processed within 15 business days upon receiving the returned item(s), using the original payment method.
9. Warranty and Liability Limitation
• Product Warranty: We provide a limited warranty of 1 month warranty for manufacturing defects. This warranty does not cover ordinary wear and tear, accidental damage, or misuse.
• Limitation of Liability: Our liability is limited to the purchase price of the products. The Company shall not be liable for indirect, incidental, or consequential damages, including lost revenue or profits.
10. Force Majeure
The Company is not liable for any failure or delay in fulfilling obligations under these Terms due to events beyond our control, including but not limited to natural disasters, acts of war, government restrictions, labor disputes, and other force majeure events.
11. Amendments to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on our website or notification to customers and will apply to all transactions made after the effective date of such changes.
12. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of Spain. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Madrid, Spain.
